Welcome to HarrogateInteriors.co.uk website terms and conditions for use. These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions, you may not use or access this website.


Definitions
"Conditions" means these terms and conditions; "Product" means a product displayed for sale on the website; "Product Details" means that part of the Website where certain terms and conditions in respect of the individual Product are provided; "Users" means the users of the website collectively; "Personal Information" means the details provided by you on registration; "We/us" means HarrogateInteriors.co.uk; "Website" means the website located at www.HarrogateInteriors.co.uk or any subsequent URL which may replace it; "Cookies" means small text files which our website places on your computer's hard drive to store information about your shopping session and to identify your computer; "United Kingdom" means England, Wales, Scotland, Northern Ireland and the Channel Islands and "You" means a user of this website.


Use of the website 
You are provided with access to this website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.


You warrant that:

•     The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and

•     You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
•     You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your Personal Information.



We reserve the right to:

•     modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website; and/or

•     change the Conditions from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions, you must immediately stop using the Website.



To provide increased value to our Users, we may provide links to other websites or resources for you to access at your sole discretion. We are not responsible for the availability of such external sites or resources, for the privacy practices of such websites, the content of such websites, or the use to which others make of these websites or resources.



Data Protection 
HarrogateInteriors.co.uk will take all reasonable precautions to keep the details of your order and payment secure but unless the HarrogateInteriors.co.uk is negligent, HarrogateInteriors.co.uk will not be liable for unauthorised access to information supplied by you. Read our Privacy Policy.


Product details and prices 
Every effort is made to ensure that product details, descriptions and prices shown are accurate at the time you place your order. If an error is found, HarrogateInteriors.co.uk will inform you as soon as possible. If the price shown is incorrect, we will offer you the option of reconfirming your order at the correct price, or cancelling.

All items are offered subject to availability. If on receipt of your order, the item(s) you have ordered become no longer available, HarrogateInteriors.co.uk will inform you as soon as possible, giving you the option of purchasing an alternative product. If you decline this option, a reduction in payment equal to the value of the unavailable items will be made.


Product imagery 
We have gone to great lengths to illustrate our products, but each image should be viewed in conjunction with the descriptive text and will, of course, be limited by the screen settings of your own monitor screen. If an exact colour match is vital, we recommend you order a sample swatch or contact us.


Payment 
We ask for payment in advance of delivery. This is via paypal on our secure shopping system, or by cheque or postal order for UK customers.

After you send your order you will receive a copy by email, please print or keep this copy for your own records. This does not mean we have accepted your order. Once your credit has been approved, the receiving address has been verified, and the item has been located, your order will be accepted.

All prices shown are in £ (GBP) sterling, and are inclusive of UK VAT at 20%. If you would prefer to pay by cheque, cash or bank transfer, please contact us at the showroom as we can only accept your order by telephone or mail or by prior arrangement.



Shipping, delivery and postage and packing 

**PLEASE NOTE, INSTALLATION IS NOT OFFERED ON LIGHTING, OTHER ELECTRICAL ITEMS, MIRRORS & ANYTHING THAT REQUIRES FIXING TO A WALL**

All relevant postage and packing, shipping or delivery charges are included in the cost of your order. The goods you order will be delivered to the address you give when you place your order. We aim to dispatch all orders within 14 days of the item being in stock but please allow up to 28 days. During busy times, or for bespoke orders, this timeframe may increase. A working day is any day other than weekends, bank or public holidays. If delivery cannot be made to your address for reasons under HarrogateInteriors.co.uk's control, we will inform you as soon as possible.

If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations, HarrogateInteriors.co.uk shall refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the order, less any expenses incurred for failed delivery.

Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, HarrogateInteriors.co.uk will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, HarrogateInteriors.co.uk will inform you as soon as possible.

If a carrier is used, upon receipt of your order you will be asked to sign for the items received in good condition. If you are unable to check the contents of the package at that moment in time please sign for the delivery as "UNCHECKED". Failure to do so may affect any claim for replacement or refund that you make thereafter.

*All items in the stock sale are available to be delivered on the same day or within 7-10 days depending on location*


Your Right of Cancellation (Distance Selling Regulations)
You have the right to cancel the contract at any time up to the end of 7 working days after you receive your order (see below). To exercise your right of cancellation, you must give written notice to HarrogateInteriors.co.uk by letter, fax or email, giving details of the items ordered and (where appropriate) their delivery. Notification by phone is not sufficient.


If you exercise your right of cancellation after the items have been delivered to you, you will be responsible for returning them to HarrogateInteriors.co.uk at your own cost. The items must be returned to our Showroom: Harrogate Interiors, The House, Leeds Road, Pannal, HG3 1EW.


You must take reasonable care to ensure the items are not damaged in the meantime or in transit.


Once you have notified HarrogateInteriors.co.uk that you are cancelling the contract, HarrogateInteriors.co.uk will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the items. If you do not return the goods as required, HarrogateInteriors.co.uk may charge you a sum not exceeding the direct costs of recovering the items.


Returns policy 
Should you wish to return anything to us, our returns policy is set out below. If we make a mistake with your order, or if the goods received are in some way faulty, we have a no quibble returns policy. Simply return the item and we will replace it with the correct one. We will pay your return delivery costs. Returns should be made within a reasonable time (usually 28 days) and in original, undamaged packaging. If you change your mind for any other reason, we are happy to exchange items, refund or credit your account, provided the goods are returned to us within 7 working days of their receipt, in the original packaging and in a saleable condition. This does not include configurable items and products with a drop down option in the product listing. However, you can return your configurable/option item but you will incur a 30% re-stocking fee and 100% of delivery fees.

 

Please return items to: Harrogate Interiors, The House, Leeds Road, Pannal, HG3 1EW. We regret, however, that in this case we cannot refund return postage costs. We are not responsible for return postage or packages that fail to reach us

 

If you require, we can collect the goods at a cost of £65 within the UK mainland only. Regrettably, self assembly furniture cannot be returned once assembly is part or fully completed, unless the item is deemed faulty. Divans, duvets, pillow products and mattresses are non-returnable once unwrapped, unless they are faulty. This is for reasons of health and hygiene. Your statutory rights are not affected.

 

HarrogateInteriors.co.uk will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the items once they have been received by our warehouse.

 

Bespoke and Tailored items
Products made with your own fabric or altered specifically for you not using off the peg options cannot be refused, returned or refunded unless they are defective or have been damaged by us in transit.


Out of stock items
Sometimes, items are for a variety of reasons temporarily unavailable. We try to alert you to this fact on the website, but just occasionally, demand exceeds supply. If a product you have ordered is out of stock at our suppliers, we tell you about the problem, dispatch the rest of your order as normal, and place the out of stock item on back order. We try to estimate when new stocks will arrive and always give you the option of cancelling either the whole order or simply the out of stock item, if you would prefer not to wait. The out of stock item will be forwarded to you immediately it becomes available.


Ex-Display items
Items that are marked as ex-display will have a detailed description on the faults and possibly a picture, they will also be the subject of wear and tear and therefore may contain small scratches and marks. These items cannot be returned unless the fault was not as described. If you wish to request pictures before sale we are more than happy to do so.


V.A.T. (Value Added Tax) 
All prices on this website include a UK sales tax of 20% for V.A.T. This applies to UK customers and those resident within the European Union (EU). If you live outside the EU, this tax will be deducted from your order at checkout. Please note that to be eligible for a VAT reduction, we need to deliver to an address outside the EU.


Limitation of Liability 
HarrogateInteriors.co.uk's total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods. Nothing in these conditions excludes or limits the liability of HarrogateInteriors.co.uk for death or personal injury caused by the Supplier's negligence or fraudulent misrepresentation.



If you are a business customer HarrogateInteriors.co.uk shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.


Applicable Law 
These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
